'Pros' and 'Cons' of the model Evolution of the Autonomous State


The member of the Board of Trustees of the FAES Foundation, Gabriel Elorriaga; the Professor of Constitutional Law, Teresa Freixes, and the Professor of Constitutional Law, José María Castellá have debated the evolution of the Autonomous State, during the fourth day of the Summer Course FAES 2019, in a table moderated by Miguel Marín, director of the course.

The Autonomic State has generated positive results 

G. ELORRIAGA | "The model is imperfect in many respects, but in general terms it has worked very well, especially in the communities of the general regime”

M.MARÍN | "The current autonomous model has generated good results, although it has a series of elements susceptible to debate: the element of solidarity, the element of asymmetry and the element of financing"

The 'pros' of the autonomous model

G. ELORRIAGA | "The great virtue of the Autonomous State has been to constitute an internal political counter-power. The fact of avoiding a model of absolute concentration of power in a central government has acted as a mechanism of democratic equilibrium and consolidation".

The cons of the autonomic model

G. ELORRIAGA | "The main weakness of the model is financing. The lack of transparency of the financing model".

M. CASTELLÁ| "In the Autonomous State it is very difficult to detect responsibilities because the distribution of competences is very complex. The citizen does not perceive who makes the decision and is confused when it comes to demanding responsibilities".

T.FREIXES| "Traditionally it has been believed that Spain functions as a federal State, but centrifuging competences, without articulating cooperation mechanisms to ensure that the system is not denatured".

The problem of Catalonia

J.M. CASTELLÁ| "The 2006 Statute was a warning that there were problems"

T. FREIXES| "They have put democracy above the law, and this will cost a lot to change"

Education and communication in Catalonia

J.M. CASTELLÁ| "The Catalan anomaly is the educational system media. They are monopolized and used politically"

T. FREIXES| "There can't be 17 ' taifas educativas'"

J.M. CASTELLÁ| "A constitutional reform is not the solution to the problem"

"The only thing federal proposals do is delay independence"

G. ELORRIAGA | "Reforms are desirable, but not feasible today"

"A mistake has been made historically: to think of reforms from a theoretical perspective, alien to political reality"

"If something happens, and it will only be when we have a more favourable political situation, it will be a succession of small reforms"

"Catalonia's problem is political, not juridical-constitutional, and the solution does not involve constitutional reform. We are not going to appease the beast by means of cessions"

What is the solution for Catalonia?

T. FREIXES| "It is necessary to achieve a change in the political majorities within Catalonia or it will be very difficult to be able to articulate a response to independence"

G. ELORRIAGA | "Catalonia must rebuild a political alternative other than independence, or we are lost"
